Protecting your personal data matters to us. This privacy policy explains which personal data we process in connection with visiting and using our NUVELLISE online shop and for what purposes.

The online shop operates under the NUVELLISE brand and the domain nuvellise.ch.

PERSONAL DATA WE PROCESS

Depending on how you use the online shop, the following personal data may be processed in particular:

• first and last name;
• billing and delivery address;
• email address and, where applicable, telephone number;
• order and transaction data;
• selected payment method and payment status;
• information about returns, complaints or customer enquiries;
• account data if you use a customer account;
• IP address;
• device, browser and technical usage information;
• information about use of our online shop;
• consents and settings relating to cookies, marketing and communications.

Full credit card details or comparable sensitive payment data are generally processed by the payment providers used.

PURPOSES OF PROCESSING

We process personal data in particular to:

• receive and fulfil orders;
• enable and allocate payments;
• ship products and track deliveries;
• handle customer enquiries and complaints;
• process refunds and justified claims;
• operate a secure, functioning online shop;
• detect or prevent fraud and abuse;
• meet legal and accounting obligations;
• improve our online shop and offer;
• send marketing and newsletters with the appropriate consent;
• use analytics, personalisation or marketing technologies with the appropriate consent.

BASES FOR PROCESSING

Where processing requires a legal basis, it is carried out in particular:

• to initiate or perform a contract, for example for orders, payments, delivery or customer service;
• to comply with legal obligations;
• on the basis of legitimate private interests, for example the secure, reliable and economical operation of our online shop and fraud prevention;
• on the basis of your consent where required, particularly for certain marketing or tracking activities.

Consent may be withdrawn with effect for the future.

SHOPIFY

Our online shop is operated through Shopify.

In providing the shop, Shopify processes technical usage data as well as customer, order and transaction data, among other information.

Depending on the Shopify feature used, Shopify acts as a processor for NUVELLISE or processes certain data under its own responsibility, for example for certain Shopify services such as Shop or Shop Pay.

If Shopify Network Intelligence features or comparable advanced Shopify services are enabled, Shopify may use information from interactions with our shop, Shopify and other Shopify merchants to provide services such as fraud protection, analytics or personalisation.

Where consent is required, the relevant data is only used in accordance with your privacy settings or consent.

PAYMENTS AND TWINT

To process payments securely, we disclose the necessary information to the selected payment provider.

Depending on the payment method, this may include Shopify Payments, TWINT and the banks, payment providers or card networks involved in technical payment processing.

These providers process the data required for payments partly under their own responsibility and in accordance with their respective privacy policies.

NUVELLISE generally only receives the payment information required to process and allocate an order.

SHIPPING AND FULFILMENT

We use Printify, Inc. and the printing and shipping partners fulfilling the particular order to process, print and deliver orders. Printify passes the necessary order and delivery data to these partners.

These partners only receive the personal data necessary to process and deliver the order. This may include the name, delivery address, order information and, where applicable, contact details needed for delivery.

Depending on the product and shipping route, fulfilment or shipping partners may be based outside Switzerland.

Regardless of this, NUVELLISE remains your point of contact for your order.

NEWSLETTER AND MARKETING

If you subscribe to our newsletter, we use your email address to provide information about NUVELLISE, new products, offers and similar content.

Marketing messages are only sent where permitted by law.

Newsletter subscription emails are sent on the basis of your consent. Where Swiss law permits this for existing customers and our own similar products, messages may also be sent within the statutory requirements.

Every marketing email contains a simple, free way to unsubscribe.

This does not affect service emails about orders, payments, shipping or customer enquiries.

COOKIES AND SIMILAR TECHNOLOGIES

Our online shop uses cookies and similar technologies.

Technically necessary cookies enable basic shop functions such as the cart, checkout, security and sign-in.

Other technologies may be used for analytics, personalisation or marketing.

Where consent is required, these technologies are only used following your corresponding choice.

You can change or withdraw your choice through the privacy settings provided in the shop.

DISCLOSURE TO SERVICE PROVIDERS

Where necessary for the relevant purpose, personal data may be disclosed in particular to the following categories of recipients:

• shop and hosting providers;
• payment providers;
• banks and payment networks;
• fulfilment and logistics partners;
• shipping providers;
• IT and cloud service providers;
• email and communications providers;
• analytics and security providers;
• authorities where we are legally required to do so.

We only disclose the data necessary for the relevant purpose.

PROCESSING ABROAD

The services we use may involve processing personal data outside Switzerland.

For Shopify, processing may take place particularly in Ireland, Canada and the USA, as well as with other service providers used by Shopify.

According to Shopify, it uses appropriate safeguards for international data transfers, including recognised standard contractual clauses and binding corporate rules where required.

When orders are processed through Printify, necessary order and delivery data may also be processed in the USA and other countries. An item's production location is therefore not the same as the location of all data processing. Such transfers are limited to the information necessary to fulfil the specific order and, where applicable, take place in direct connection with performing the sales contract.

For other transfers to countries without an adequate level of data protection recognised by Switzerland, we ensure that Swiss data protection requirements are met, for example through appropriate contractual safeguards or a statutory exception.

RETENTION PERIOD

We only store personal data for as long as required for the relevant purposes or for statutory retention obligations.

Order and accounting data may be retained for ten years under statutory retention requirements.

Other data is deleted or anonymised when no longer needed for the relevant purpose and when there is no legal obligation or legitimate reason for further retention.

DATA SECURITY

We take appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, alteration or unlawful disclosure.

We rely in particular on the security measures of our carefully selected technical and organisational service providers.

However, no data transmission or storage can guarantee absolute security.

YOUR RIGHTS

Under Swiss data protection law, you may in particular have the right to:

• request information about the personal data we process;
• have inaccurate personal data corrected;
• request deletion where there are no legal or overriding grounds for further processing;
• request the release or transfer of certain personal data subject to statutory conditions;
• withdraw consent with effect for the future.

MINORS' DATA

Our online shop is not specifically directed at children.

We do not knowingly collect children's personal data for purposes requiring a parent or guardian's consent under applicable law without having the necessary consent.

If you believe such data has been supplied to us without authorisation, you can contact us.

CHANGES

We may update this privacy policy when our processing, services or legal requirements change.
