PROVIDER AND SCOPE

Welcome to NUVELLISE.

These General Terms and Conditions apply to orders placed through the NUVELLISE online shop at nuvellise.ch.

The online shop is operated by:

NUVELLISE is the trading name under which the online shop operates.

These terms apply to all orders customers place through our online shop.

OUR OFFER

NUVELLISE offers clothing with original designs. Depending on the product, items are made or printed after an order is received. The information in the relevant product description is authoritative.

We endeavour to describe all products, materials, colours, dimensions and characteristics as accurately and clearly as possible.

The presentation of products in the online shop does not constitute a binding contractual offer.

ORDERS AND CONCLUSION OF CONTRACT

Before submitting an order, customers can check the selected products and their information and correct them where necessary.

Clicking the appropriately labelled order button indicating an obligation to pay submits a binding order.

Receipt of the order is confirmed immediately by email.

If, exceptionally, an ordered product is unavailable despite the availability displayed, or an order cannot be fulfilled for an important reason, we will inform the customer as quickly as possible.

Payments already made for unavailable products will be refunded in full.

PRICES AND PAYMENT

All prices are stated in Swiss francs (CHF).

The stated prices are the final prices applicable to the respective product. Statutory public charges and non-optional surcharges are taken into account in accordance with applicable law.

Any shipping costs are transparently displayed and visible before completion of the order at the latest.

If, exceptionally, the customer must bear additional customs, import or other costs for a delivery, these will be transparently stated before completion of the order.

The payment methods shown at checkout are available for payment. These may include TWINT and card and wallet payments supported by Shopify Payments.

Payment is processed through the selected payment provider.

SHIPPING AND DELIVERY

NUVELLISE currently delivers within Switzerland.

Estimated delivery times are stated in the online shop, in connection with the relevant product or during the ordering process.

Unless expressly identified as binding, delivery times are realistic estimates.

NUVELLISE may appoint shipping, logistics and fulfilment partners for dispatch and order processing.

If an order is significantly delayed, we endeavour to inform the affected customer as early as possible.

Our aim is transparent, traceable delivery. Where tracking is available for an order, we provide the relevant tracking information.

WITHDRAWAL AND RETURNS

For ordinary online purchases, Swiss law generally does not provide a general statutory right of withdrawal or return simply because of a change of mind.

NUVELLISE generally does not grant a general voluntary right of withdrawal or return for goods that are free from defects and correctly delivered, unless expressly stated otherwise for the relevant product.

Details about returns, damaged or incorrectly delivered goods and personalised products are set out in our withdrawal, returns and refunds policy.

Statutory claims for defective or incorrectly delivered goods remain unaffected.

DEFECTS AND WARRANTY

Quality matters to us.

If an item is damaged, defective or incorrectly delivered, please contact us as promptly as possible at: info@nuvellise.ch.

A brief description and, if possible, photos of the affected product are helpful.

Defects are governed by the statutory provisions of the Swiss Code of Obligations, particularly Articles 197 et seq.

The statutory limitation period for warranty claims for new goods is generally two years from delivery.

For justified complaints, we endeavour to find a straightforward, appropriate solution.

PRODUCT IMAGES AND MATERIALS

We value the most realistic possible presentation of our clothing.

Colours may differ slightly from the actual goods depending on the screen, device settings and lighting conditions.

Information about materials and characteristics is provided to the best of our knowledge based on the product information available to us.

Special care instructions are provided with the relevant product or delivery where necessary or useful.

DATA PROTECTION

Responsible handling of personal data matters to us.

Information about which personal data we process, for what purposes and which service providers are involved is available in our privacy policy.

Shopify and the payment, shipping and other service providers used may process data for the technical operation of the online shop and payment processing.

INTELLECTUAL PROPERTY

NUVELLISE texts, designs, logos, graphics, original images and other content may not be copied, reproduced or otherwise used for commercial purposes without prior consent, unless a statutory exception applies.

Third-party rights remain reserved.

LIABILITY

NUVELLISE's liability is governed by the applicable provisions of Swiss law.

Mandatory statutory claims and liability provisions remain reserved in all cases.

APPLICABLE LAW AND JURISDICTION

Swiss law applies.

Mandatory statutory jurisdictions apply to contracts with consumers.

In particular, the statutory jurisdictions at the consumer's place of residence are not restricted.

Where no mandatory statutory jurisdiction applies, the place of jurisdiction is Bern, Switzerland.

CHANGES TO THESE TERMS

NUVELLISE may amend these General Terms and Conditions for future orders, for example when the offer or legal framework changes.

An order is governed by the version of these terms available in the online shop at the time the order was placed.
